In North Carolina, you must be separated for one (1) year in order to file for divorce.  However, you will want to handle your marital issues as soon as possible after, or sometimes before, your separation occurs.

The marital issues can be handled with a Separation and Property Settlement Agreement, but only if your spouse agrees to sign.  If you cannot obtain a resolution through a Separation and Property Settlement Agreement, the martial issues can be handled in court in front of a judge or through mediation.
